But last month, the same jury said he should be sentenced to life imprisonment rather than death by lethal injection, a surprising decision considering that jurors had declined earlier opportunities to spare him a death sentence. CENTENNIAL, Colo. (AP) -- James Holmes was an angry quitter who gave up on life and turned his hatred into murder and mayhem against innocent victims in a Colorado movie theater, the judge said Wednesday before formally sentencing him to life in prison.

"It is almost impossible to comprehend how a human being is capable of such acts," Judge Carlos A. Samour Jr. said.

Samour contrasted Holmes' bloody assault with the compassion of a juror who voted for a life sentence instead of the death penalty. And he noted the trial was fair, even if some victims were disappointed that Holmes didn't get the death penalty.

"I believe in the system," Samour said. "I said that before, and I'll say it again. I believe in the system."

Samour formally sentenced Holmes to life in prison without parole for the murders of 12 people. He also was sentencing Holmes to more than to 3,200 additional years for attempted murder and an explosives conviction. 

The judge had no other sentencing option on the murder charges after a jury earlier this month did not unanimously agree that Holmes should get the death penalty. Samour issued his sentence after two days of testimony from survivors of the attack, including first responders.

But he first spent more than half an hour defending the integrity of the justice system and disputing complaints that the trial was a waste of time. He noted the proceedings gave family members an opportunity to tell the world about their slain loved ones and provided survivors the chance to talk about their ordeal.

Samour disputed some victims' suggestion that Holmes would have an easy life behind bars, noting prison is harsh and restrictive.

More than 100 victims and survivors testified this week about the searing physical and emotional scars the 2012 shooting has left.

Holmes' mother, Arlene, was the final witness to take the lectern Tuesday. She said her son feels remorse for his deadly attack on a Colorado movie theater. She said his mental illness and medications make it hard for him to express it.

"We know that is very, very hard for people to see," Arlene Holmes testified. "We cannot feel the depths of your pain. We can only listen to everything you have expressed, and we pray for you. ... We are very sorry this tragedy happened, and sorry everyone has suffered so much."

Jurors rejected Holmes' insanity plea, convicting him of murdering 12 people and trying to kill 70 others when he opened fire on a packed theater in suburban Denver on July 20, 2012.Prosecutors have said the jury was divided on the sentence, with 11 favoring death and one favoring life without parole. Under Colorado law, jurors must be unanimous to impose the death penalty, so Holmes automatically got a life sentence.

To the end, Holmes' state-appointed attorneys blamed the massacre on his schizophrenia and psychotic delusions. They said Holmes was obsessed with the idea of mass killing since childhood, and he pursued neuroscience in an effort to find out what was wrong with his brain.

Prosecutors pointed both to Holmes' elaborate planning for the attack and his refusal to divulge to anyone - family, friends, psychiatrists - that he was thinking, and planning, murder.

Holmes stockpiled guns and ammunition and mapped out the Aurora theater complex to determine which auditorium would allow for the most casualties. He even calculated police response times.

Defense attorney Daniel King said Tuesday Holmes will not appeal his conviction, sparing victims the possibility of another emotionally wrenching trial.

Holmes' sentencing hearing was largely symbolic but gave scores of victims an unprecedented chance to vent their feelings to the judge. They told him of flashbacks and nightmares, of relentless survivor's guilt and enduring physical pain.

Walmart's Plan To Stop Selling AR-15s Has A Major Flaw

Walmart confirmed Wednesday that it plans to stop selling the sort of military-style weapons used in deadly shootings in Aurora, Colorado, and Newtown, Connecticut, among other places in recent years.

Gun control advocates argue that limiting the availability of such weapons -- specifically by removing them from the world's largest brick-and-mortar retailer -- will make them less likely to fall into the hands of would-be mass murderers. Walmart's decision to pull the guns from its shelves, which it claims is not motivated by political pressure, should be cheered.

But by confirming that AR-15s and other, similar guns will soon disappear from the one-third of Walmart stores where they have been available, Walmart may spark a surge of sales that would only increase the number of people who possess these weapons.

Basically, any time widespread accessibility to these rifles appears to be in jeopardy, sales skyrocket. A gun-buying frenzy kicked off after the 2o12 massacre in Newtown, in which a gunman murdered 20 schoolchildren and six adults with an AR-15.  The same thing happened after the shooting at Columbine High School in 1999. It happened after then-Rep. Gabrielle Giffords (D-Ariz.) was shot in a rampage near Tucson in 2011. And it happened after a gunman killed 12 people in a movie theater in Aurora in 2012, The Christian Science Monitor reported at the time. 

"When people think they won't be able to buy guns, they buy guns," an unnamed firearms industry analyst told CNBC in 2012.

So it was a bit disconcerting this week that when Walmart first publicly confirmed its plans to start paring down its firearm offerings, it did so to Bearing Arms, a vehemently pro-gun blog that bills itself as saving "liberty and lives."

It's possible that the article's author, Bob Owens, was simply the first to ask the retailer about its plans, and therefore the first to get the news. But the message that AR-15s and similar guns are in danger of becoming harder to find will no doubt resonate especially strongly with the readers of such a site.

Walmart did not immediately respond to a question about why it first gave the news to Breaking Arms. Spokesman Kory Lundberg had earlier told The Huffington Post that the weapons will be available for another few weeks.

Even after the retailer stops carrying these particular weapons, though, it will still be the biggest seller of guns in the country.

James Holmes was sentenced to 12 life sentences plus 3,318 years on Wednesday after a jury failed to reach a unanimous decision on the death penalty earlier this month.

The 27-year-old former graduate student was found guilty of killing 12 people and wounding 70 more during a screening of “The Dark Knight Rises” at an Aurora, Colorado, movie theater, in July 2012. A judge handed down a life term for each person he killed, plus 3,318 years for the attempted murders of those he wounded and for rigging his apartment with explosives, reported CNN. He is not eligible for parole.

“It is the court’s intention that the defendant never set foot in free society again,” Judge Carlos A. Samour Jr. said after imposing the sentence. “If there was ever a case that warranted a maximum sentence, this is the case. The defendant does not deserve any sympathy,” he added, before demanding Holmes be immediately removed from the courtroom.

Prosecutor George Brauchler later said he believed the sentence to be the fourth longest in U.S. history.

Holmes was found guilty on July 16 on 24 counts of first degree murder, two for each of his victims, after a nearly three-month trial. The jury rejected his lawyers’ argument that Holmes was not guilty by reason of insanity, however one lone holdout did not agree to the death penalty.

In the infamous attack, Holmes, a former doctoral student in neuroscience, walked into a theater 30 minutes into the movie dressed in black tactical gear. He dropped two smoke-emitting canisters and then opened fire on the crowd with a 12-gauge shotgun and a semi-automatic rifle.

The shooting rampage was one of the most deadly in recent U.S. history, with the victims ranging in age from 6 to 51.

His sentencing came on the same day that WDBJ7 reporter Alison Parker and photographer Adam Ward were killed doing a standard live shot with an interviewee at Bridgewater Plaza near Moneta, Virginia, when a gunman opened fire on them live.

Vester Flanagan, the suspect in the shooting and a former colleague of the two journalists, died Wednesday of a self-inflicted gunshot wound after leading police on a car chase, authorities said. Reported by The Wrap 6 hours ago.
