The charges facing Fox News reporter Jana Winter were dropped on Tuesday, sparing her from having to reveal confidential sources she consulted for a story on the Aurora movie theater shooting.

New York State's Court of Appeals voted to knock down an earlier decision which would require Winter to appear in front of Arapahoe County District Court in Colorado to disclose the source who gave her information about a notebook that the gunman, James Holmes, gave to his psychiatrist just prior to the shooting, Fox News reported on Tuesday. Winter reportedly said that she would go to jail before revealing such information to a judge.

The high court presented its decision Tuesday morning:
"An order from a New York court directing a reporter to appear in another state where, as here, there is a substantial likelihood that she will be compelled to identify sources who have been promised confidentiality would offend our strong public policy."
The decision marks a notable victory for shield laws and legislation protecting journalists.

"Confidential newsgathering is essential for investigative journalism to flourish, and the New York Court of Appeals has issued a broad decision protecting all New York-based journalists," Winter's attorney, Dori Ann Hanswirth said. Members of Restoration Community Church will start their Christmas by serving breakfast to the homeless. Restoration Community Church (RCC) is providing and serving breakfast to people who don't have a home to celebrate Christmas.

Fox News Reporter Scores A Victory For Every Journalist In America New York's top court ruled on Tuesday that Fox News reporter Jana Winter will not have to testify in the trial of Aurora, Colo., movie-theater shooting suspect James Holmes.

The 4-3 decision (which you can see below) from the New York Court of Appeals protects Winter from having to reveal her sources from a bombshell exclusive story that detailed a chilling notebook Holmes mailed to a University of Colorado psychiatrist that was "full of details about how he was going to kill people." Holmes allegedly killed 12 people and injured dozens in a shooting during a midnight showing of "The Dark Knight Rises" on July 20, 2012.

The ruling, which was based on New York's state "shield law," reverses a lower court's ruling that determined she would have to testify. If the New York Court of Appeals had upheld that decision, Winter would have been compelled to testify in the case. She could have faced jail time if she refused to reveal her source.

"Today's ruling is a major win for all journalists," Fox News Chairman and CEO Roger Ailes said in a statement. "The protection of Jana Winter's confidential sources was necessary for the survival of journalism and democracy as a whole. We are very grateful that the highest court in New York State agreed with our position."

Here's the key part of the majority decision:

Moreover, as a New York reporter, Winter was aware of — and was entitled to rely on — the absolute protection embodied in our Shield Law when she made the promises of confidentiality that she now seeks to honor. Given that this is the case, and in light of the significant disparity between New York and Colorado law, she was entitled to have the Shield Law issue adjudicated in New York before the subpoena was issued, even though it relates to testimony sought in the courts of another state. We therefore conclude that an order from a New York court directing a reporter to appear in another state where, as here, there is a substantial likelihood that she will be compelled to identify sources who have been promised confidentiality would offend our strong public policy — a common law, statutory and constitutional tradition that has played a significant role in this State becoming the media capital of the country if not the world.

Winter's lead attorney, Dori Ann Hanswirth, told Business Insider leading up to the decision that the case could have a sweeping effect on journalists' protections in New York, the heavily concentrated center of the media. 

Hanswirth said that compelling Winter to testify would set the precedent that New York's shield law "can really be gutted."

"Who only reports on things that happen in New York State?" she said.

First Amendment advocates cheered the decision on Tuesday. 

“This is an important victory for journalists everywhere, and it protects the ability for the public to get the information it needs to self-govern,” said David Cuillier, the president of the Society of Professional Journalists.

In what journalists are calling a victory for freedom of the press, the New York State Court of Appeals decided Tuesday that FoxNews.com reporter Jana Winter does not have to reveal her sources in the Aurora, Colorado movie theater shooting case.

“Today’s ruling is a major win for all journalists,” Fox News chairman and CEO Roger Ailes said in a statement.

“The protection of Jana Winter’s confidential sources was necessary for the survival of journalism and democracy as a whole. We are very grateful that the highest court in New York State agreed with our position.”

Winter was subpoenaed by prosecutors in the trial of admitted gunman James Holmes to reveal who gave her access to a notebook Holmes sent to his psychiatrist, which reportedly contains graphic violent drawings and details about his intention to kill people.

Despite the fact that shield laws exist in Colorado, which are designed to protect journalists in criminal cases such as these, Winter’s subpoena was nevertheless approved and upheld by a lower New York court – which has jurisdiction over her employer – in January. Tuesday’s 4-3 ruling upholds that the reporter cannot be compelled to return to Colorado to testify.

“New York’s Shield Law provides an absolute privilege that prevents a journalist from being compelled to identify confidential sources who provided information for a news story,” Judge Victoria Graffeo writes in the decision.

“[A]n order from a New York court directing a reporter to appear in another state where, as here, there is a substantial likelihood that she will be compelled to identify sources who have been promised confidentiality would offend our strong public policy.”

Holmes pleaded not guilty by reason of insanity in June for allegedly shooting and killing 12 people and wounding 70 during a midnight screening of “The Dark Knight Rises” at a movie theater in Aurora in July 2012. Prosecutors are seeking the death penalty.

Mysterious green lightning, seen emerging from an ash cloud in images of a May 2008 volcanic eruption in Chile, is likely more common than we realize, according to research presented Monday during the annual fall meeting of the American Geophysical Union in San Francisco.

Green lightning had not really been observed before photographer Carlos Gutierrez snapped photographs of the Chaiten volcano eruption, according to Olive Heffernan of National Geographic. The origin of the unusual phenomenon was unknown until Arthur Few, an atmospheric scientist and professor emeritus at Rice University, began investigating the unusual climatic event.

“I thought, 'That's funny; why don't we see this in lightning storms?'” Few said during the conference. Despite the fact that the Chaiten eruption is known to have given off visible green lighting, Few believes that the phenomenon is not all that unusual, said Larry O’Hanlon of Discovery News. He believes that it is more common than people realize, but is most likely hidden inside of regular thunderstorms.

“The concealment results from the structure of storm clouds,” Heffernan said. “On the inside, the clouds contain ice crystals that are either positively or negatively charged. Surges of electricity occur between positively and negatively charged regions within the cloud – lightning – but they remain inside, unseen by even the most committed storm chasers. In contrast, volcanic ash clouds carry their electrical charges on the outside, where they are sparked by fragments of rock forcefully ejected into the air during an eruption.”

What Few doesn’t understand, and is currently attempting to find out, is why the ash column produced during the Chilean eruption produced visible green lighting. For answers, he looked at other atmospheric phenomena which appear to be green, such as the northern lights. The aurora glows green, red and white when their oxygen atoms are excited by electrons originating from space. Above 100 km, the northern lights appear to be green.

“My working hypothesis is that the green ones are actually streamers,” Few explained. Streamers are lightning bolts which are effectively “a positive channel being pulled to a negative charge” occurring higher up in the ash cloud. Essentially, the white lightning visible in the Chaiten pictures is a negative charge generating throughout the cloud and curving into its bottom, while the green lighting is the positive streamer that reverses the flow, O’Hanlon said. WASHINGTON -- There have been many instances of mass gun violence during the presidency of Barack Obama. Some faded away without much public recognition, while others grabbed the attention of the national press and motivated members of Congress to dust off long-shelved legislative responses.

The shooting at Sandy Hook Elementary School in Newtown, Conn., nearly one year ago was different than all the others, and not only because it involved 20 first-graders being massacred in their classrooms by a madman. It sparked an unprecedented public debate over gun violence in the United States. By wide margins, more Americans tuned into the ongoing discussion about gun control than they did after prior incidents, including the shooting at Fort Hood, the shooting in an Aurora, Colo., movie theater and the near-assassination of Rep. Gabrielle Giffords.

They continued to pay attention in subsequent weeks, as the president and Democrats in Congress began pushing bills to expand background checks, limit the availability of assault weapons and cap the size of ammunition magazines. None of those bills passed. And, over time, Americans' attention faded away.

Colorado Town to Vote on Hunting, Shooting Down Drones

Deer Trail, Colorado (population 598) was scheduled to vote on measure allowing residents to "hunt for federal drones and shoot them down." The vote was originally scheduled for yesterday but has been rescheduled while the district court determines whether the ordinance is legal. 

The author, Phillip Steel, wrote the measure after learning about "loosened regulations that would allow the flight of drones in domestic airspace."

"What has me fired up is it’s trespassing," he said. "It doesn’t belong there. Yes, it’s privacy. But that’s only one part of it. Who’s going to be flying these drones?"



The ordinance specifies the kinds of weapons and ammunition residents could use and puts a bounty on recovered parts — $25 for the fuselage or wing, $100 for a whole drone that has U.S. government markings.

The idea has found some support in Deer Trail, which takes up less than one square mile and is about 50 miles outside Aurora.



"I would shoot a drone down if it’s peering in my window, scanning me, and it’s within elevation where I can nail it," said Robert Copely, a resident.
