Fracking Fight Developing In Nation's Driest Areas

SAN FRANCISCO -- The latest domestic energy boom is sweeping through some of the nation's driest pockets, drawing millions of gallons of water to unlock oil and gas reserves from beneath the Earth's surface.

Hydraulic fracturing, or the drilling technique commonly known as fracking, has been used for decades to blast huge volumes of water, fine sand and chemicals into the ground to crack open valuable shale formations.

But now, as energy companies vie to exploit vast reserves west of the Mississippi, fracking's new frontier is expanding to the same lands where crops have shriveled and waterways have dried up due to severe drought.

In Arkansas, Colorado, New Mexico, Oklahoma, Texas, Utah and Wyoming, the vast majority of the counties where fracking is occurring are also suffering from drought, according to an Associated Press analysis of industry-compiled fracking data and the U.S. Department of Agriculture's official drought designations.

While fracking typically consumes less water than farming or residential uses, the exploration method is increasing competition for the precious resource, driving up the price of water and burdening already depleted aquifers and rivers in certain drought-stricken stretches.

Some farmers and city leaders worry that the fracking boom is consuming too much of a scarce resource, while others see the push for production as an opportunity to make money by selling water while furthering the nation's goal of energy independence.

Along Colorado's Front Range, fourth-generation farmer Kent Peppler said he is fallowing some of his corn fields this year because he can't afford to irrigate the land for the full growing season, in part because deep-pocketed energy companies have driven up the price of water.

"There is a new player for water, which is oil and gas," said Peppler, of Mead, Colo. "And certainly they are in a position to pay a whole lot more than we are."

In a normal year, Peppler said he would pay anywhere from $9 to $100 for an acre-foot of water in auctions held by cities with excess supplies. But these days, energy companies are paying some cities $1,200 to $2,900 per acre-foot. The Denver suburb of Aurora made a $9.5 million, five-year deal last summer to provide the oil company Anadarko 2.4 billion gallons of excess treated sewer water.

In South Texas, where drought has forced cotton farmers to scale back, local water officials said drillers are contributing to a drop in the water table in several areas.

For example, as much as 15,000 acre-feet of water are drawn each year from the Carrizo-Wilcox Aquifer to frack wells in the southern half of the Eagle Ford Shale, one of the nation's most profitable oil and gas fields.

That's equal to about one-half of the water recharged annually into the southern portion of the aquifer, which spans five counties that are home to about 330,000 people, said Ron Green, a scientist with the nonprofit Southwest Research Institute in San Antonio.

The Eagle Ford, extending from the Mexican border into East Texas, began to boom in 2011, just as Texas struggled with the worst one-year drought in its history. While conditions have improved, most of the state is still dealing with some level of drought, and many reservoirs and aquifers have not been fully replenished.

"The oil industry is doing the big fracks and pumping a substantial amount of water around here," said Ed Walker, general manager of the Wintergarden Groundwater Conservation District, which manages an aquifer that serves as the main water source for farmers and about 29,000 people in three counties.

"When you have a big problem like the drought and you add other smaller problems to it like all the fracking, then it only makes things worse," Walker said.

West Texas cotton farmer Charlie Smith is trying to make the best of the situation. He plans to sell some of the groundwater coursing beneath his fields to drillers, because it isn't enough to irrigate his lands in Glasscock County. Smith's fields, like the rest of the county, were declared to be in a drought disaster area this year by the USDA.

"I was going to bed every night and praying to the good Lord that we would get just one rain on the crop," said Smith, who hopes to earn several thousand dollars for each acre-foot of water he can sell. "I realized we're not making any money farming, so why not sell the water to the oil companies? Every little bit helps."

The amount of water needed to hydraulically fracture a well varies greatly, depending on how hard it is to extract oil and gas from each geological formation. In Texas, the average well requires up to 6 million gallons of water, while in California each well requires 80,000 to 300,000 gallons, according to estimates by government and trade associations.

Depending on state and local water laws, frackers may draw their water for free from underground aquifers or rivers, or may buy and lease supplies belonging to water districts, cities and farmers. Some of the industry's largest players are also investing in high-tech water recycling systems to frack with gray or brackish water.

Halliburton, for instance, recently started marketing a new technology that allows customers to use recycled wastewater, calling it an "investment to further the sustainable development of the oil and gas industry." The American Petroleum Institute, the principal lobbying group for the industry, said its members are working to become less dependent on fresh water, and instead draw on other sources.

"Recycling wastewater helps conserve water use and provide cost-saving opportunities," said Reid Porter, a spokesman for the group.

In some states, regulators have stepped in to limit the volume or type of water that energy companies can use during drought conditions.

In northwest Louisiana, as the production rush began in the Haynesville Shale in 2009, the state water agency ordered oil and gas companies to stop pulling groundwater from the local aquifer that also supplied homes and businesses, and use surface water instead. That order is still in effect and has helped groundwater levels to recover, said Patrick Courreges, a spokesman for the Louisiana Department of Natural Resources.

In Colorado's Weld County, home to Peppler's farm and more than 19,000 active oil and gas wells, some officials see selling unneeded portions of their allotments from the Colorado River as a way to shore up city budgets.

The county seat of Greeley sold 1,575 acre-feet of water last year to contractors that supply fracking companies, and made about $4.1 million. It sold farmers nearly 100 times more water but netted just $396,000.

"The oil and gas industry is a small but significant player," said Jon Monson, director of the city's water department, which has designated 35 fire hydrants where haulers may fill up their tanks to truck to gas wells. "Just knowing that oil and gas is a boom-and-bust industry, we are trying to not get used to it as a source of revenue because we know it won't last."

Some environmental groups argue that local and regional planners should let the public weigh in on how much drilling can be supported in drought-stricken areas. Some states require oil and gas companies to disclose the chemicals and the amount of water they use in fracking operations on FracFocus.org, a website formed by industry and intergovernmental groups in 2011, but the statistics are not complete.

"We don't want to look up 20 years from now and say, `Oops, we used up all our water,'" said Jason Banes of the Boulder, Colo.-based Western Resource Advocates.

In California, oil companies are pressing for further exploration of the massive Monterey Shale, a 1,750-square-mile area extending from the agricultural Central Valley to the Pacific Ocean that federal energy officials say could ultimately comprise two-thirds of the nation's shale oil reserves.

In Ventura County, at the southern tip of the Monterey Shale and an hour north of Los Angeles, drought-induced pressures on local water systems are already visible; one local water district predicts some groundwater wells will go dry by summer.

David Schwabauer, a fourth-generation farmer in the county, said overtures by companies that want to drill new wells amid his avocado and lemon groves are prompting difficult conversations about how to manage the family farm. One orchard relies on irrigation from an overdrawn aquifer, while the other is kept alive using expensive water piped in from the distant Sierra Nevada mountains.

"Some parts of the family have very strong feelings against it, given the challenges that we face environmentally," Schwabauer said. Skipping Breakfast Linked To Diabetes In Overweight Women

A new study finds skipping breakfast causes acute or rapid onset insulin resistance in overweight women. Chronic insulin resistance is a risk factor for diabetes suggesting that if breakfast is repeatedly omitted, it may contribute to an individual developing type 2 diabetes.

Elizabeth Thomas, MD, an endocrinology fellow at the University of Colorado School of Medicine in Aurora explained, “Our study found that acute insulin resistance developed after only one day of skipping breakfast.”

When a person is in insulin resistance, they need more insulin to lower their glucose level, commonly referred to as blood sugar.

The study involved nine non-diabetic overweight or obese women with an average age of 29. On two different days approximately one month apart, subjects were randomly assigned to either receive breakfast or no breakfast on their first visit and the opposite for the second visit. After four hours, all participants received a standardized lunch with blood samples taken every thirty minutes for three hours following lunch.

It is a normal response for glucose levels to rise after eating which triggers insulin production. Researchers discovered when participants skipped breakfast their insulin levels were much greater than on the day they ate breakfast. According to Thomas, the heightened insulin levels are an indication of acute insulin resistance.

Thomas explained it was not clear if this “heightened metabolic response” was temporary or lasting, but it may contribute to the development of chronic insulin resistance. If insulin resistance is chronic, it leads to a buildup of sugar in the blood which may lead to prediabetes and diabetes.

“This information should help health care providers in counseling patients as to why it is better to eat a healthy, balanced breakfast than to skip breakfast,” Thomas said.

This study was funded by the Endocrine Fellows Foundation in Washington, DC, the National Institutes of Health and the Colorado Nutrition Obesity Research Center.

FBI Used Secret Law To Obtain Secret Evidence On Accused Terrorists: Report

WASHINGTON, June 18 (Reuters) - The FBI has used secret evidence obtained under the Foreign Intelligence Surveillance Act to prosecute at least 27 accused terrorists since 2007, according to a Reuters review of public records.
While the recent spotlight has been on the use of the FISA law by the U.S. National Security Agency for surveillance programs following disclosures by former NSA contractor Edward Snowden, the FBI also makes extensive use of the law for domestic counterterrorism.
The Reuters review highlights the extent to which the FBI has come to rely on FISA to investigate or thwart domestic attacks. It involved searching the national court docket using the database of Westlaw, which is owned by Thomson Reuters Corp, and includes only cases where prosecutors are required to file a notice under FISA. Other cases where FISA was used may be sealed.
The 27 cases in which the Federal Bureau of Investigation has used FISA evidence include both well-publicized and less-known investigations. They range from mass murder charges against Army psychiatrist Nidal Hasan for the shootings of 13 people at Fort Hood, Texas, in 2009, to the arrest in April of an 18-year-old in Chicago accused of planning to join an al Qaeda-linked group fighting in Syria. Both men await trial.
In an effort to shore up support for the NSA program, U.S. spy agencies may disclose publicly, as early as Tuesday, for the first time a list of at least 25 terrorist attacks they say were thwarted by the agency's once-secret surveillance operations. Many, if not all, of those NSA operations also used FISA for intelligence gathering.
When the FBI uses FISA, it seeks approval from judges at the secret U.S. Foreign Intelligence Surveillance Court (FISC) for phone, email and electronic surveillance and for searches of property, including "sneak-and-peak" search warrants in which agents covertly enter a business or home when the occupants are away, and try to leave no trail of their visit.
The public court records, often little more than a one-page notification by a Justice Department attorney, provide no specific details of these covert operations. Some case files include defense challenges to the FISA law; none have been successful.
The court files show that the FBI used FISA warrants in recent cases against an Oregon man charged with aiding a Pakistani suicide bomber; a Philadelphia man accused of joining an Uzbekistan terrorist organization; and two Somali-born Minnesota women convicted of raising funds for al Qaeda-affiliated al-Shabaab rebels.
They also include FBI investigations of the New York founder of a radical Islamic website and a Moroccan man convicted of plotting a suicide attack at the U.S. Capitol.
An FBI spokeswoman referred questions about the bureau's use of FISA to the Justice Department, and a spokesman there declined to comment.

SECRET COURT
FISA warrants are issued by the FISC in Washington. It was created in 1978 following congressional hearings that exposed illegal surveillance of U.S. citizens - without court-authorized warrants. The court includes 11 judges, all of whom are veteran federal judges at the trial court level. They are appointed by the chief justice of the U.S. Supreme Court to seven-year terms.
Applications to the judges for FISA warrants are presented by U.S. prosecutors. While FISA warrants are issued in secret, once an arrest is made by the FBI, U.S. law requires prosecutors to file a short notice to the court if they intend to use classified evidence at trial.
In addition to terrorism cases, the FBI has used FISA warrants in at least nine espionage and arms and military technology smuggling investigations since 2007.
The 27 alleged terrorism cases identified by Reuters in which the FBI used FISA evidence, and later disclosed that fact, represent only a small sampling of warrants issued by the secret court. Last year alone, the government applied for 1,856 FISA warrants and - except for one that was withdrawn - all were granted.
The public records only identify cases in which the FBI used FISA evidence to make terrorism arrests inside the United States.

NSA CASES
In some cases where prosecutors filed a public court notice that the FBI used FISA, the NSA is also involved but the authorities are not required to disclose that in court.
For instance, U.S. officials have since the Snowden disclosures identified two such cases - a U.S. man implicated in the 2009 attack by armed Pakistani militants in Mumbai, India, that killed 166 people, and an attempted plot against the New York City subway the same year.
In the New York case, the alleged plot leader, Najibullah Zazi, pleaded guilty to terrorism charges and is awaiting sentencing. An alleged co-conspirator, Adis Medunjanin, was sentenced to life in prison.
In a paper circulated to Congress on Saturday, U.S. intelligence agencies said that broad NSA email monitoring under a program made public by Snowden, called Prism, played a critical role in leading U.S. investigators to Zazi, while sweeping NSA telephone data collection produced leads that led investigators to Medunjanin.
According to court records, the FBI also used FISA warrants to make cases against:
- Abdella Ahmad Tounisi, 18, of Aurora, Illinois, who was arrested in April for allegedly trying to join al Qaeda-linked fighters in Syria. He is awaiting trial. U.S. officials say he was a friend of Adel Daoud, an American accused of trying to set off a bomb outside a downtown Chicago bar last year.
- Jesse Curtis Morton, a Muslim convert from Brooklyn who founded the Revolution Muslim website, which is linked to a half dozen other terrorism cases inside the United States, according to court documents. Morton is serving a 12-year sentence for posting online threats against the founders of the South Park television program.
- Amine El Khalifi, a Moroccan sentenced last year to 30 years in prison for plotting a suicide attack on the U.S. Capitol.
- Reaz Qadir Khan, a Portland, Oregon, municipal worker charged in April with conspiring to provide material support to a fatal 2009 suicide bombing at a regional Pakistani intelligence headquarters in Lahore. He awaits trial.
- Betim Kaziu, a Brooklyn man convicted of conspiracy to kill U.S. soldiers overseas and sentenced to 27 years in prison.
- Bakhityor Jumaev, a Philadelphia man arrested last year in Denver and charged with being a member of an Islamic terrorist group allegedly seeking to overthrow the government of Uzbekistan. He awaits trial.

Adam ‘Pacman’ Jones to Speak at NFL Rookie Symposium If there is anyone in the NFL capable of understanding the temptations and troubles that come along with young stardom and seemingly infinite amounts of cash and varying degrees of stardom, it’s Adam ‘Pacman’ Jones. Or as Jones would more simply describe it, the ‘pitfalls’ of stardom.

As such, who better to speak at this year’s rookie symposium, than none other than Adam Jones. And speak, he will.

For the second straight year Jones will be speaking to a room of recently drafted NFL rookies. He is scheduled to deliver his speech, or talk, or discussion sometime next week. The rookie symposium is scheduled to last between June 23-29 in Aurora, Ohio.

There is some controversy regarding whether Jones should be allowed to speak to the rookies, following his most recent arrest on an assault charge for what is being described as an open handed slap of a woman after she allegedly threw a beer bottle at him. She suffered minor injuries as a result of the incident. Jones has plead not guilty to this misdemeanour assault charge and even tweeted that he was “protecting himself”.

Getting arrested is nothing new for Jones. In 2012 he would plead guilty to a misdemeanor charge of disorderly conduct. Jones has also pled no contest to an equivalent of no contest misdemeanour to commit disorderly conduct, in an incident at a Las Vegas strip club. The manager of the club was paralyzed from the waist down and one of the bouncers was wounded when a gunman, who claimed to be acting at Jones behest, opened fire in the club following Jones’ posse being kicked out. To this day Jones denies any involvement whatsoever in the shooting, which is going to cost him somewhere in the neighbourhood of $11M.

Can only hope this year’s crop of rookies heeds every last word uttered out of Jones’ mouth - assuming he’s still allowed to talk. Who knows, maybe if Jones had listened at his symposium, he wouldn’t always find himself in trouble.

The E-470 Public Highway Authority is a government enterprise organized as a single purpose agency to operate the E-470 toll road. Filmmaker GUILTY In YouTube Terrorism Hoax

PHOENIX -- An Arizona man on trial for sending his 16-year-old nephew into a busy intersection last summer with a fake grenade launcher was convicted Monday of endangering the teen's life and carrying out a terrorism hoax.

Jurors in Maricopa County Superior Court got the case Monday afternoon and deliberated two hours before finding 40-year-old filmmaker Michael David Turley guilty of endangerment and knowingly giving a false impression in the July 28 mock terrorism scenario at a northwest Phoenix intersection.

Sentencing is set for Aug. 8. Prosecutors said Turley faces penalties ranging from probation to more than five years in prison.

Turley's attorney, Brad Rideout, said he planned to "argue for probation" for his client unless he wants to appeal the verdict.

"We haven't discussed that with him yet," Rideout said. "My client is in shock."

In a YouTube video that Turley made of the hoax, his young relative was dressed in a sheet, had a scarf wrapped around his head, made erratic movements while in a crosswalk and pointed the fake weapon at vehicles, prompting motorists to call 911.

Prosecutor Michael Anderson told jurors in closing arguments Monday that Turley, who was responsible for his nephew's safety that day, could have gotten his young relative killed in the hoax.

Anderson said some motorists who saw the teen with the realistic-looking fake launcher had discussions about whether they should run him over. Still, some recordings of 911 calls also showed that some witnesses assumed the weapon was a fake.

Rideout said callers weren't terrified and instead figured they were witnessing a joke, pointing out that they could see his client filming the hoax and that his nephew did a brief dance while on the street corner.

Earlier in the trial that began June 11, Rideout told jurors that it was foolish for Turley to get his nephew involved but noted that no one was injured and no vehicles wrecked as a result of the hoax.

In testimony last week, Turley said his video of the hoax was meant to be satirical and that most passing motorists laughed at them. He told jurors he didn't think his actions endangered his nephew's life.

In the YouTube video, a narrator identified as Turley said he wanted to see how long it would take authorities to respond to a terrorist situation and mentioned a movie theater shooting two weeks earlier that killed 12 people in Aurora, Colo.

The teenager carried the fake launcher on his shoulder as he made his way across a crosswalk. The narrator said the teen wanted to appear as intimidating as possible in hopes that people would call police.

The video also showed the first police officer to arrive on the scene, finding the 16-year-old standing in his uncle's driveway. The officer calmly told the teenager to put down the weapon and Turley to put down the camera. The officer didn't draw his gun.

Police left without making any arrests, but Turley was taken into custody nearly two months later after officers interviewed people who called emergency services and later saw the video posted on YouTube. Reported by Huffington Post 7 hours ago.

A Wall Street Journal columnist drew some heat on Tuesday for declaring that recent investigations into sexual assault in the military were nothing more than a "war on men."

Activists and members of Congress have fought a highly publicized campaign in recent months to curb the astounding levels of rape and assault in the military. The Journal's James Taranto, though, was apparently so disturbed by one investigation that he called the entire debate "a political campaign against sexual assault in the military that shows signs of becoming an effort to criminalize male sexuality."
