54 out of 64 CO Sheriffs File Lawsuit Against New Anti-Gun Law (Video)

84% of all Colorado sheriffs have filed a lawsuit against the new gun law that passed earlier this Spring in the wake of the Sandy Hook school shooting. The  sheriffs are hoping to have the new restrictions invalidated because they believe they violate the Second Amendment.

The Colorado Legislature passed two laws that are set to take effect July 1 which limit the size of the of ammunition magazines to 15 rounds and expand background checks to private and online firearm sales.


Sheriffs from 54 of the state's 64 counties are involved in the lawsuit because believe it's their duty to uphold the U.S. Constitution.

According to the Associated Press, El Paso County Sheriff Terry Maketa said "We each took an oath. The line in the sand has been drawn, and we will stand united," at the Friday Denver press conference announcing the lawsuit.








The National Rifle Association has issued a statement supporting the lawsuit filed Friday in federal court.




"The National Rifle Association, the many plaintiffs in this case, and the law-abiding gun owners in the state of Colorado know that the recently enacted gun control laws are unconstitutional," said Chris W. Cox, executive director of the NRA's Institute for Legislative Action.

Colorado State Senator Mary Hodge (D-Brighton) the sponsor of HB 13-1224, limiting high-capacity magazines was disappointed at the filing.




"We diligently crafted these public safety laws with respect given to the Second Amendment constitutional rights of every American," she said. "These laws were not constructed haphazardly; they were constructed to protect us from massacres like the ones we suffered in Aurora and Newtown. We worked with constitutional lawyers, and studied laws that we know worked in other states. We can't just sit by and do nothing while first-graders and moviegoers are being mowed down in one fell swoop with weapons equipped with large-capacity magazines.





"The sheriffs who are filing these lawsuits are playing politics and playing into the strategy of the east-coast based NRA elites. Some of these particular politicians have even vowed not to implement these moderate public safety laws. Reasonable Coloradans know that one doesn't need a large-capacity magazine for self-defense, and an instant background check isn't an inconvenience because it can save lives. These reasonable public safety laws yield to every one of our constitutional rights, including our Second Amendment rights, and they promote domestic tranquility, a guarantee in the preamble of our constitution. It's time to stop playing politics and start protecting Coloradans from massacres and unnecessary gun violence."

Don't be driving under the influence at any time—and if you are DUI, you can get arrested if you drive through downtown Geneva in the wee hours of the morning. Here are two examples from the Geneva Police Department blotter:

*DUI—*Geneva police arrested Joseph Vernagallo, 34, of Geneva on charges of driving under the influence of alcohol, speeding and no valid driver’s license after a traffic stop around 12:49 a.m. May 11 in the 300 block of West State Street, reports said. Vernagallo has a court date of June 12 at the Kane County Judicial Center, 37W777 Route 38, St. Charles.

*DUI—*Geneva police arrested Ashley Kuntz, 27, of Batavia on charges of driving under the influence of alcohol, DUI with a blood-alcohol content of .08 or more and speeding after a traffic stop around 1:42 a.m. May 12  in the 300 block of West State Street, reports said. Kuntz has a court date of June 5 at the Kane County Judicial Center, 37W777 Route 38, St. Charles.

*DUI Warrant—*Batavia police arrested Ale J. Morgan, 25, of Aurora on a DuPage County warrant for failure to appear and driving under the influence. He posted $825 plus a credit card fee and has a court date of June 5.

Colorado Sheriffs Sue Over New Gun Control Laws

DENVER -- Colorado sheriffs upset with gun restrictions adopted in the aftermath of last year's mass shootings filed a federal lawsuit Friday, challenging the regulations as unconstitutional.

The lawsuit involves sheriffs from 54 of Colorado's 64 counties, most representing rural, gun-friendly areas of the state.

The sheriffs say the new state laws violate Second Amendment protections that guarantee the right to keep and bear arms. Opponents are criticizing the lawsuit as political maneuvering.

The filing targets Colorado laws that limit the size of ammunition magazines and expand background checks. The regulations passed the Legislature this spring and are set to take effect July 1.

It isn't yet clear whether the sheriffs' challenge will delay or jeopardize the laws. The filing, however, guarantees the renewal of a fierce debate over gun control.

Colorado lawmakers passed the restrictions in reaction to the shooting rampage at a suburban Denver movie theater last summer, where 12 people were killed and dozens more were wounded, and the massacre at an elementary school in Newtown, Conn.

The gun control debate was one of the most emotionally charged of the legislative session, with lengthy debates and national attention. President Barack Obama added to the attention on the Colorado Statehouse, as his administration unsuccessfully pushed Congress to enact similar gun controls.

Sheriffs' attorneys are considering whether to ask the court for a preliminary injunction, which would block the Colorado laws while the lawsuit moves forward.

The law enforcement community is divided on the issue. In contrast to the sheriffs, the Colorado Association of Chiefs of Police, which includes urban departments, supports the laws. The chiefs said the measures were "common-sense approaches" to protect the public "while not taking guns from law-abiding citizens in any way."

Unlike sheriffs, police chiefs are not elected.

Democrats maintain the public is on their side, and say legislators carefully crafted the proposals that were signed.

"These laws were not constructed haphazardly," said Democratic Sen. Mary Hodge, the sponsor of the magazine limit. "They were constructed to protect us from massacres like the ones we suffered in Aurora and Newtown."

Relatives of victims of the Colorado shooting criticized the sheriffs for filing the lawsuit and accused them of playing politics.

"As a parent who lost my son Alex at the Aurora theater shooting, I ask these people to put themselves in my place," Tom Sullivan said in a statement. "I do not understand why these politicians are picking guns over people."

Weld County Sheriff John Cooke said he and his colleagues were "not the ones playing politics with this."

"We believe that the Legislature were the ones who were playing politics," he said.

Gun control opponents say the language in the regulations is unclear and doesn't provide safeguards to prevent people from inadvertently breaking the laws.

Ammunition magazines, for example, are easily converted to larger sizes, which the bill bans. Gun rights advocates also say the law expanding background checks doesn't provide enough exemptions for temporary transfers and that people conducting private transactions will have a difficult time getting appropriate checks.

Lawmakers allowed several exemptions in the background check legislation, including transfers between immediate family members, shooting events and temporary transfers of up to 72 hours.

State officials, including Attorney General John Suthers, have worked to defend the intent of the laws. Suthers, a Republican responsible for defending the law against the legal challenge, issued a statement Friday giving guidance to law enforcement on how the magazine limit should be enforced.

He said magazine features "must be judged objectively" and that magazines that hold 15 rounds or fewer can't be defined as "large capacity" simply because it can be modified to include more.

The state has 30 days to respond to the lawsuit.

· Matthew Summerfield, 31, 875 E. Second Ave. Apt. 204, Lombard, was arrested and charged with DUI and driving without insurance after police pulled over his blue Honda Civic for speeding at First and Highland at 1:11 a.m. He was released on bond.
· Kevin E. Berg, 239 Claremont, Elmhurst, was arrested and charged with DUI, obstructing a peace officer and failure to yield after police pulled over his green Toyota Camry for disobeying a stop sign and speeding at Addison and Second at 1:53 a.m. A passenger in the vehicle, Evan J. Fendley, 21, 201 N. Geneva St., Elmhurst, was arrested and charged with obstructing a peace officer. They were released on bond.
· Daniel Palczynski, 27, 120 W. Hillside Drive, Bensenville, was arrested and charged with DUI at North Avenue and Route 83 at 3:40 a.m. He was released on bond.

*May 16: *Eamon Hennen, 26, 472 S. Kenilworth, Elmhurst, was arrested and charged with DUI, possession of cannabis and possession of drug paraphernalia after police pulled over his gray Mazda 3 for improper lane use and expired registration at York and Adams at 1 a.m. He was released on bond.

*May 12: *Fernando Munoz, 21, of the 800 block of Brentwood Drive, West Chicago, was charged at 4:30 a.m. with DUI, speeding and driving an uninsured motor vehicle at Roosevelt Road and Parkside.

*May 11: *Keith A. Martinez, 35, of the first block of Briar Street, Glen Ellyn, was charged at 1:23 a.m. with DUI, speeding and no driver's license at Geneva Road and Main Street.

*May 6: *Florencio Marquez-Mendez, 20, of the 500 block of Lynn Court, Glendale Heights, was charged with the following:

· Aggravated driving under the influence
· Illegal transportation of alcoholic liquor
· Uninsured motor vehicle
· Suspended or revoked driver's license
· Failure to reduce speed to avoid an accident

Police arrested Marquez-Mendez at 4:01 p.m. on Main Street and High, according to a report. Police also charged Concepcion Marquez, 32, same address, with permitting an unauthorized person to drive.

*HINSDALE*

*May 12:* Trevor T. Andrews, 27, of the 25600 block of Shoal Creek Drive, Monee, was charged with the following:

· Driving under the influence of alcohol
· Improper lane usage
· Driving while license suspended
· Speeding

Police at 2:18 a.m. stopped Andrews at 55th Street and Camberly Court for speeding and improper lane use, according to a report. He was observed to be under the influence of alcohol and refused a breath test, police said. He was charged and released to appear in court.

*May 7: *Joel R. Harrison, 44, of the 700 block of Westfield, St. Charles, was charged with driving under the influence of alcohol with a BAC .08 or more, speeding and improper lane usage. Police at 10:08 p.m. stopped Harrison at 55th and Quincy streets for speeding, according to a report. He was observed to be under the influence of alcohol and submitted a breath test, which indicated his blood alcohol content was greater than .08. He was charged and released to appear in court.

*LEMONT*

*May 5: *Mantas Storpirstis, 36, of the 200 block of Heather Glen Drive, Aurora, was arrested at 1:52 a.m. following a traffic stop at Archer Avenue and Bell Road. Storpirstis was charged with driving under the influence of alcohol and improper lane usage. He was issued a June 11 court date at the Bridgeview Courthouse.

*WHEATON*

*May 11:*

· Police charged Chase R. Howard, 20, of the 24W700 block of Merrill Drive, Wheaton, with driving under the influence of alcohol and illegal consumption of alcohol by a minor. Howard was driving a dark green 2005 Jeep Grand Cherokee at 2:59 a.m. at Plamondon and Orchard Road when police initiated a traffic stop. Howard was booked at the Wheaton Police Department and later released.

· Police charged Jessica L. Hill, 28, of the 2600 block of Wingate Court, Aurora, with driving under the influence of alcohol. Hill was driving a maroon or burgundy 2009 Chevy Aveo at 2:12 a.m. at Butterfield and Naperville roads when police initiated a traffic stop. Hill was booked at the Wheaton Police Department and released later that morning. During the same incident, police arrested Michael E. Parker, 28, of the 1000 block of Briarbrook Drive, Wheaton, on an Aurora police arrest warrant for failure to pay. Parker was released from the Wheaton Police Department later that morning.

*May 4: *Police charged Jeffrey B. Lawson, 18, of the 21W400 block of Burdett Road, Lombard, with driving under the influence of drugs, possession of cannabis and possession of drug paraphernalia. Lawson was driving a white 1999 Ford Taurus at 12:13 a.m. at Bloomingdale and Geneva Road when police initiated a traffic stop. Lawson was booked at the Wheaton Police Department and released later that morning.

Most of the traffic stops in Batavia for the past couple weeks have had to do with no valid driver's license or driving with a suspended or revoked license, but there were a few arrests that involve additional charges. Here's a roundup:

 

TRAFFIC ARRESTS MAY 6 to MAY 12, 2013

· Police arrested Juan Mora, 34, of St. Charles on charges of no valid driver’s license after a traffic stop around 3:54 p.m. May 12 on South Batavia Avenue, reports said. Mora also was issued a warning citation for having an unsafe tire/wheel. He was released from the scene and has a court date of June 11.
· Police arrested Manuel Octavio Martinez-Alba, 27, of North Aurora on charges of no valid driver’s license and driving while license suspended around 8:55 May 12 at Bond and South Batavia Avenue, reports said. Martinez-Alba posed  $150 bond and has a court date of June 11.
· *Illegal Transportation of Alcohol—*Batavia police arrested Michael P. Connard, 46, of West Chicago on charges of improper signaling, illegal transportation of alcohol and driving while license suspended, according to a report filed around 11:55 p.m. May 11, reports said. Connard was released with a court date of June 11.
· Police arrested Paulino Bautista-Bello, 23, of Aurora on charges of failure to reduce speed to avoid an accident, no valid driver’s license and operating an uninsured motor vehicle after a collision at West Fabyan Parkway and Route 31 around 3:41 p.m. May 9, reports said. Bautista-Bello posted $200 bond and has a court date of June 11.
· Police arrested Timothy Dreyer, 21, of Aurora on charges of driving while license suspended, disobeying a stop sign and speeding, after a traffic stop around 9:33 p.m. May 9 at Ridgelawn Trail and Hart Road, reports said. Dreyer posted $150 bond and has a court date of June 11.
· *Accident With Injuries Arrest—*Police arrested Rolando Pedraza, 49, of West Chicago on charges of no valid driver’s license and operating an uninsured motor vehicle, after an accident involving three vehicles around 6:45 a.m. May 7 in the 1400 block of North Kirk Road, reports said. Two of the drivers refused medical treatment and one was transported to Delnor Hospital, reports said. Pedraza has a court date of June 18.

· Batavia police arrested Lilia Corral, 53, of Batavia on a charge of driving while license suspended around 6:19 p.m. May 2 in the 200 block of North Randall Road, reports said. She was issued a warning notice for improper display—tinted or obscured plastic cover. She posted an I-bond and has a court date of June 11.
· Police arrested Martha Aguirre, 37, of Batavia on a charge of no valid driver’s license around 12:53 a.m. May 1 in the 200 block of East Wilson Street. She was released on her signature and has a court date of May 21.
· Police arrested Martin Castro-Jamie, 29, of Batavia on charges of speeding and driving while license suspended in the 1000 block of Wilson Street, around 1:19 p.m. May 1 in the 1000 block of East Wilson Street, reports said. He posted $150 bond and has a court date of June 4.
· Batavia police arrested Pedro Hernandez, 46, of West Dundee on charges of no valid driver’s license, operating an uninsured motor vehicle, operating a vehicle with expired registration around 2:57 p.m. May 1, reports said. He posted $150 bond and has a court date of June 11.
· Police arrested Maria J. Calderon, 36, of Aurora on charges of no valid driver’s license around 12:21 a.m. May 2, reports said. No further information was available at the time of the report.
· Batavia police arrested Jorge Sanchez-Davalos, 27, of Aurora on charges of driving while license suspended. He post $150 bond and has a court date of June 4.
· *Traffic Arrest/Warrant Service—*Police arrested Mario Alvarez, 34, of West Chicago on charges of driving while license suspended, operating an uninsured motor vehicle, no valid driver’s license and improper display of front registration after a traffic stop around 10:16 a.m. April 29, reports said. Alvarez posted I-Bond and has a court date of June 11. Police also discovered Alvarez had an outstanding warrant from DuPage County for failure to appear/driving while license suspended. He posted $500 bond plus the $75 service fee and has a court date of May 28.
· Police arrested Eddi Ramos-Perez, of Aurora on charges of driving while license suspended and speeding around 1:22 p.m. April 29 in the 500 block of South River Street, reports said. He posted $150 bond and has a court date of June 4.
· Police arrested Eulogio Gonzalez-Garcia, 68, of Batavia on charges of driving while license suspended, failure to yield at an intersection, and operating a vehicle with no BAIID when required, according to a report filed at 6:50 p.m. April 29 at the intersection of North Raddant Road and East Wilson Street, reports said. Gonzalez-Garcia posted $160 bond and has a court date of May 15.
· Batavia police arrested Javier Contreras-Lopez, 24, of Elgin around 9:01 p.m. May 3 at the intersection of South Kirk Road and Chillem Drive on charges of no valid driver’s license. He also was issued a warning notice for speeding. Contreras-Lopez posted $150 bond nad has a court date of June 11.

New industry standards and complexities of patient care call for nurses to receive additional education beyond basic pre-licensure requirements. Many hospitals and health care organizations are calling for nurses to either earn a BSN or RN to MSN degree. Now more than ever, nurses should consider going back to school and determine how they can leverage the push for an advanced degree to accomplish career and personal goals.

“It’s important for nurses to evaluate their thoughts and feelings about continuing their education and ask themselves if there is a specific career path they would like to take, or if they want to move up the nursing ladder, earn more promotions to receive higher salaries and gain greater respect from their peers,” says Karen Whitham, EdD(c), MSN, RN, CNE, chair of nursing, RN-BSN programs at American Sentinel University. “By addressing their career and professional motivations, they will be able to determine if they are BSN-ready and if this is the right path for them to realize their goals.”

Many nurses who return to school to fulfill an employer’s requirements do not believe, at first, that their new BSN will change the way they practice nursing. However, several key factors are behind the push for a workforce of BSN-prepared nurses, says Whitham.

“Several studies have demonstrated that lower levels of patient mortality are associated with advanced education levels of the nurses. Increased education is also associated with patient safety and quality of care,” she says.

The Robert Wood Johnson Foundation (RWJF) and the Institute of Medicine (IOM) launched an initiative to respond to the need to assess and transform the nursing profession. Whitham points out the initiative recommends that organizations achieve a 90 percent BSN-prepared nurse workforce by 2020.

Whitham says that there are several key characteristics of BSN-ready nurses.

Baccalaureate graduates have education that enhances their professional development and enables them to better understand the cultural, social, political and economic issues that influence health care.

Additionally, nurses with the ability to think in a systematic and logical manner will reflect on and question the reasoning process to ensure quality care.

Due to the complexity of today’s health care environment, Whitham says that bachelor’s level nurses are better prepared for leadership, management, in-depth research and community health and education roles.

“A BSN nurse may work in a hospital setting and hold positions in education or management or work in the private or public sector,” says Whitham. “A BSN is the first step toward furthering their education, such as earning a MSN or Ph.D.”

Barbara Annette Loomis, 83, was a Member of the Oswego Presbyterian Church Patch Montgomery, IL --

Barbara Annette (Munson) Loomis, 83 years, of Oswego, IL, peacefully passed away on May 16, 2013 at Bickford Cottages of Oswego.  She was born July 28, 1929 in Waltham, IL, the daughter of the late Arthur and Clara Munson. 

Barbara grew up on a farm in Waltham, IL and graduated from Mendota High School.  She was united in marriage to Richard Loomis on April 7, 1956.  She and her husband moved to Oswego in 1958 where they raised their family.  She was a member of the Oswego Presbyterian Church.

Barbara is survived by her children, Jim Loomis of Plano, IL, Ann (Mark) Cotter of Naperville, IL, Jane DeMont of Sandwich, IL, David Loomis of Sandwich, IL, grandson, Ryan Cotter of Naperville, IL, sister Louise Robinson of Peru, IL, and many nieces and nephews.  She was preceded in death by her parents, husband Richard, brothers Alan and Bruce Munson, and nephew Henry Munson. 

Visitation will be on Tuesday, May 21, 2013 from 9:30 -11 AM with the memorial service at 11:30 AM at the Oswego Presbyterian Church, 1976 Illinois Route 25, Oswego, IL.  The service will be officiated by Reverend Leon Aalberts.  Burial will be private. 

Memorials may be directed to either the Wayside Cross Ministries, 215 E. New York St., Aurora, IL 60505 or The Kendall County Food Pantry, 1204A Deer Street, Yorkville, IL 60560.

Police Investigating Fatal Shooting in South Naperville Patch Bolingbrook, IL --

UPDATE: 9:52 p.m., May 19

Naperville police are investigating a fatal shooting in south Naperville.

Kevin P. Ratcliffe, 53, of Aurora, was pronounced dead around 1:25 p.m. Friday in the 3400 block of Lacrosse Lane, less than a mile southwest of Neuqua Valley High School, according to the Will County Coroner's Office.

Preliminary autopsy reports indicate Ratcliffe died of a gunshot wound, according to the Coroner's Office. 

The final cause of death will be determined at a later date after further police, autopsy and toxicological reports.
