Aurora shooting suspect James Holmes seeks change to insanity plea

The suspect in the Aurora shooting on Monday asked a judge to enter a plea of not guilty by reason of insanity. The move is widely seen as James Holmes' best hope of avoiding the death penalty. Holmes is charged with murder and attempted murder in an attack on a movie theater in Colorado, on 20 July 2012, that killed 12 and injured 70.

Attorney Daniel King made the request in court, saying attorneys now have a diagnosis for James Holmes. He didn't specify what it was. The judge said he would consider arguments first about constitutional questions the defense has raised about Colorado's insanity law. He was expected to decide whether to accept a new plea sometime before a 31 May hearing.

Holmes had bushy hair and beard at Monday's hearing. He did not speak at all.

Prosecutors are seeking the death penalty. They say Holmes, a former neuroscience graduate student, spent months acquiring weapons and ammunition, scouting a movie theater in the Denver suburb of Aurora and booby-trapping his apartment. On 20 July, dressed in a police-style helmet and body armor, he opened fire during a packed midnight showing of The Dark Knight Rises, prosecutors say.

No motive has emerged in nearly 10 months of hearings, but Holmes' attorneys have repeatedly said their client is mentally ill. He was being treated by a psychiatrist before the attack.

A judge entered a standard not guilty plea on Holmes' behalf in March, and he needs court permission to change it. Dan Recht, a past president of the Colorado Criminal Defense Bar, said it was a foregone conclusion the judge would accept the new plea to preclude appeals later.

Holmes' lawyers have held off on changing his plea until now, fearing a wrinkle in the law could cripple their ability to raise his mental health as a mitigating factor during the sentencing phase. Two judges have refused to rule on the constitutionality of the law, saying the attorneys' objections were hypothetical because Holmes had not pleaded insanity. The defense had little choice but to have Holmes enter the plea and then challenge the law. Holmes' lawyers announced last week that Holmes would ask to change his plea at Monday's hearing.

The insanity plea carries risks for both sides. Holmes will have to submit to a mental evaluation by state-employed doctors, and prosecutors could use the findings against him.

"It's literally a life-and-death situation with the government seeking to execute him and the government, the same government, evaluating him with regard to whether he was sane or insane at the time he was in that movie theater," said Recht.

Prosecutors must convince jurors beyond a reasonable doubt that Holmes was sane. If they don't, state law requires the jury to find him not guilty by reason of insanity. "That's a significant burden on the prosecution," Recht said. If acquitted, Holmes would be committed to the state mental hospital indefinitely.

The mental evaluation could take weeks or months. Evaluators will interview Holmes, his friends and family, and if Holmes permits it they will also speak with mental-health professionals who treated him in the past, said Dr Howard Zonana, a professor of psychiatry and adjunct professor of law at Yale University. Evaluators may give Holmes standardized personality tests and compare his results to those of people with documented mental illness. They will also look for any physical brain problems. A two-day prostitution sting staged last week by Aurora Police Special Operations investigators resulted in charges being filed against four men and six women.

The operation, which was staged May 8 and 9 at an undisclosed private residence in Aurora, targeted several different internet sites known for advertising sexual services.

Three of the men were arrested and charged with solicitation of a sexual act on May 8 after they responded to the residence in reference to an ad placed by Aurora police on one of the internet sites, police said. They allegedly offered an undercover female officer money in exchange for sex. They include:

Edward W. Przybycien, 30, of the 800 block of Quin Court, Naperville; Thaddeus Chase, 45, of the 200 block of Loradale Drive, Oswego; and Anthony Chirico, 42, of the first block of Windham Drive, Montgomery.

The arrests of the women and one of the men on May 9 resulted from an undercover officer responding to advertisements on the targeted websites and setting up meetings with the suspects, police said. The suspects were arrested after they allegedly offered the male undercover officer sexual acts in exchange for money.

Charged with prostitution were:

Kandace L. Morales, 25, of the 400 block of Harwood Avenue; and Samantha R. Lang, 26, of the 3200 block of Pandora Avenue, both in Joliet; Jessica L. Morris, 19, of the 1800 block of E. Main Street, Urbana; and Rafael Medrano, 37, of the 1100 block of Lebanon Street, Aurora.

Another Aurora resident, Crystal L. Turner, 26, of the 400 block of Park Ridge Lane, was charged with prostitution and unlawful possession of a controlled substance after heroin was allegedly found in her vehicle, police said.

Two other women, Lashonda R. McClinton, 20, of the 2900 block of W. 25th Place, Chicago; and Chunxia Lui, 42, of the 5500 block of S. Madison Street, Hinsdale, were both charged with felony prostitution based on their past criminal histories, police said.

Aurora Police seized six vehicles during the operation. To retrieve them, the arrestees had to pay $500 plus towing and storage. They also seized $943 in cash.  Police are not disclosing the location used in the sting to protect the integrity of future operations.

Two Joliet women were arrested for prositution following a two-day sting in Aurora that targeted Internet sites that advertise sexual services, according to the Aurora Police Department.

Kandace L. Morales, 25, of the 400 block of Harwood Avenue, and Samantha R. Lang, 26, of the 3200 block of Pandora Avenue, were charged with prostitution in arrests that resulted from a special operations investigation conducted May 8 and 9.

Also arrested on prostitution and other charges were four women and one man from Chicago, Urbana, Hinsdale and Aurora. Three men from Naperville, Oswego and Mongomery were arrested and charged with solicitation of a sex act, police said.

The male suspects were arrested after they came to an Aurora residence referenced in an Internet ad and offered an undercover female officer money in exchange for sex, police said.

The prostitution suspects were taken into custody after undercover officers answered their ads, arranged to meet and then made a deal in which sex would be exchanged for money, police said.

Aurora police also seized six vehicles during the operation and $943 in cash.

Dorothy J Frahm, age 84, of Aurora, IL died Saturday, May 11, 2013 at Jennings Terrace in Aurora, IL.  She was born July 20, 1928 in Chicago Heights, IL the daughter of the late James and Hattie nee Sorgenfri Strickler.       

Dorothy enjoyed her time participating in activities at Jennings Terrace during her residency there.     

She is survived by her son Paul (Kathy Anderson) Frahm of Oswego, IL, grandchildren Kristina Frahm of Salisbury, MD and Paul Frahm Jr of Oswego, IL.  She was preceded in death by her husband Harley Frahm, a sister and brothers. 

Private family services will be held at a later date. Cremation was accorded the wish of the family followed by burial at Skyline Cemetery in Monee, IL. 

Memorials may be directed to Jennings Terrace  275 LaSalle St  Aurora, IL 60506.

Two producers with 70 movie credits between them vow to raise money to allow full-length “Peak of Terror” shoot for two students at CCA, a community college in Colorado

The Colorado Film School’s lone submission to the inaugural Stanley Horror Film Festival in Estes Park, Colo., was bestowed the judge’s award for best picture May 3. The Film School is a department at CCA, an Aurora and Denver community college.

“Peak of Terror,” a 20-minute sizzle reel directed by John McSween, written by McSween and Ben Dunn, and produced by Dunn, centered upon a monster terrorizing a small town and a woman confronting her past to protect the people she loves.

But the biggest news to come out of the festival for the filmmaking duo wasn’t the Stanley Dean’s Cup Award trophy or accompanying $5,000 first prize.

Sara Risher, current managing partner in Chick Flicks and former president of New Line Cinema, whose productions included the Nightmare on Elm Street series, and Colorado Film commissioner Donald Zuckerman have committed to raising the $500,000 to $1.5 million needed from investors to shoot a full-length movie stemming from the short, beginning in the fall.

Zuckerman and Risher between them have produced about 70 feature films.

Early conversation is that McSween and Dunn will write the feature, with McSween directing.

“As Donald Zuckerman told them, it will change their lives,” said Frederick Lahey, director of the Colorado Film School. “And what it means is that the professional focus of the school is paying off in the professional realizations of our students.”

The initial competition began in-house, with a script competition among Colorado Film School students to determine the best script. McSween and Dunn modeled “Peak of Terror” after movies like Jaws, which straddled the fence between terror and humor, yet still managed to develop complex characters.

They were allotted a $2,500 budget to complete the short that would be shown at the Stanley Hotel, a venue famous for hosting Stephen King while he authored “The Shining” and where King shot part of a mini-series following his dissatisfaction with Stanley Kubrick’s movie treatment starring Jack Nicholson.

The CCA students, from start to finish, employed a crew of about 30 in production and post-production, including actors crew and editors, in sites all around Colorado, including Idaho Springs, Red Feather Lakes outside of Fort Collins, Keystone and Echo Lake Lodge at the foot of Mount Evans.

The biggest surprise to the two filmmakers was their anticipation of having to sell their short to industry insiders at the film festival. Instead, they found out as they were being announced as winners of the judge’s prize that financing a full-fledged feature already was planned.

“The potential is just unbelievable,” McSween said. “It’s just surreal.”

Added Dunn, “Essentially this is a best-case scenario for a short film. A lot of people don’t realize the potential in short films you can make at the Colorado Film School. We have amazing resources at our disposal, and I feel like what we did is we wrote a short with room for a feature. We wrote a short that was maybe a little too big for its britches and its 20 minutes and executed it well.”

One of the festival judges, Britta Erickson, director of the Starz Denver Film Festival, cited the sizzle reel’s “outstanding production values, superb action and creepy animatronics,” while adding that McSween and crew “clearly showed a mastery of the genre.”

“It was kind of crazy when people that were just random festivalgoers would come up and say, ‘Hey, your movie was the best thing I saw at the festival,” McSween said.

There were 24 features and 22 shorts representing more than 15 countries screened at the competition in addition to the Stanley Dean’s Cup competition. Panel discussions and special events augmented the independent horror cinema. Organizers are hoping that the Stanley Horror Film Festival grows to become a Sundance-type gathering for the horror genre but a premier student film festival.

A la a college football rivalry game, the judge’s trophy will reside at Community College of Aurora for a year, until a new winner emerges.

Seeing the spoils of their victory on the daily basis at the Colorado Film School is fitting to both filmmakers, given the growth in their craft they’ve experienced during their time there.

“It’s really challenged me to my very core and put me in really hard situations and made me excel,” McSween said. “In terms of these projects, all of my success has to do with being (at CCA) and learning lessons. It’s also put me in contact with really talented people in the field – true artists in the film world. And just being able to work with them, I’ve learned just so much. In terms of film, it’s given me everything.”

With more to come soon, if all falls right with the financial piece.

Dunn and McSween agreed without hesitation that one day, looking back, they’ll view this moment at the Stanley Hotel as their career lucky break.

“It would be cool if they invited us back to be jurors,” McSween said with a laugh.

Barbara Anne Paul, age 72, of Aurora, IL formerly of Montgomery, IL died Sunday, May 12, 2013 at Jennings Terrace in Aurora, IL.  

She was born July 21,1940 in Chicago, IL, the daughter of the late Leonard and Rose nee Mocarski Cieslak. 

Prior to her retirement she was employed as a guidance counselor at IVVC in Sandwich, IL, Rosary High School in Aurora, IL, as well as well as in Newark, IL, Naperville, IL, and Royal Oak, MI schools.  

She had also served on the Oswego Library District board. She is survived by her daughter Ellen Paul, grandson Riley Evan Odehnal.  She was preceded in death by her husband Norman Paul, Jr. 

Private family graveside services will be held.

'Too Pretty To Be Guilty,' Dzhokhar Tsarnaev Fan Club Says

As 19-year-old Boston bombings suspect Dzhokhar Tsarnaev awaits trial, a legion of Americans -- often teenage girls -- has been furiously filling the Internet with fan club sites and support groups.

Alisha, a blond, blue-eyed 18-year-old from Topeka, Kan., is one of these Tsarnaev's "fans." Using her Twitter handle @keepitbluntedd, Alisha has been questioning the government's case against the younger Tsarnaev brother.

In an interview with the New York Post, Alisha even said she was planning on getting a quote of the teen (“If you have the knowledge and the inspiration all that’s left is to take action”) tattooed on her upper arm.

“He was just this pothead 19-year-old boy who didn’t care,” she told The Post. “I don’t see it.”

Although Alisha has decided not to get the tattoo, she has not backed down from her support for Tsarnaev. And she is far from alone.

Using the hashtag #freejahar, as well as handles -- like @FreeJaha, @Fighting4Jahar or @PrayForJaharr -- that contain Tsarnaev's nickname, the suspect's supporters are easy to find online.

There are also multiple Facebook pages, such as the "Dzhokhar Tsarnaev Free Jahar movement," which currently boasts 6,600 members. Many of these pages express similar sentiments to those expressed in the Dzhokhar Tsarnaev Free Jahar movement's "About" section:

According to Yahoo! Shine, fans have made bracelets, and the phrase "too pretty to be guilty" is becoming a common refrain.

Yahoo! spoke to several psychologists, who said Tsarnaev's appeal may stem from the myth of the "bad boy" or from a deeper motive: fame.

“It’s not that he’s a bomb suspect, it’s that he’s notorious,” Sheila Isenberg, author of “Women Who Love Men Who Kill,” told the site. “A lot are going to say, ‘I just want to make sure he gets a fair trial, but that’s really window dressing for their inherent need to get famous themselves.”

“Similar to the fascination teen girls have with vampire characters in movies and books, dark characters are a way to forge a separate identity and to defiantly (or rebelliously) declare oneself as independent of authority figures,” psychologist Jill Weber noted. “Some of this is normal teen development, but being drawn to a criminal is a dysfunctional way to forge independence.”

ABC News adds that this phenomenon is not limited to "cute" teenage suspects, either.

Luka Magnotta, the so-called "Cannibal killer," has a devoted female fan base as well, the outlet reports. Accused Aurora shooter James Holmes had a legion of fan girls all his own, including Aurora, Colo., resident Misty Benjamin, who told reporters she was "physically attracted" to Holmes.

"When I get upset, I look at his picture and I calm down," she said at the time.

Of course, social media only throws fuel on the fire, giving teens in particular an accepting, somewhat anonymous community to express their beliefs.

OUTSIDE CHICAGO, IL -- “I can’t believe I had $4.85 million in a cookie jar for over three months!” said Ricardo Cerezo after recently checking some old Lottery tickets and discovering he had won a jackpot prize of $4,850,000 in the Feb. 2 Lotto drawing.

“I’m awestruck, this is unbelievable!” Cerezo said.

Today, May 15, 2013, Illinois Lottery officials presented him with a commemorative check at the Aurora 7-Eleven where he bought his winning ticket. 

At his wife’s urging, Cerezo took 11 tickets that had accumulated in their cookie jar to the store to check them. The first seven tickets he scanned were not winners, but when he placed the eighth ticket under the scanner, the message “File a claim” appeared.

“I thought I had probably won about $600,” Cerezo said.

From there, he double checked the winning numbers on illinoislottery.com and was shocked to see that his prize amount was not $600, rather $4.85 million.

Cerezo and his wife plan to pay bills, pay off their mortgage and share some of their winnings with their son and daughter. They also plan to contribute to their church and favorite charities.

“It is very important to us that we help others with this money,” Cerezo said.

Cerezo told Lotto officials he has been playing Lotto for several years. The ticket that won the Lotto jackpot was a Quick Pick purchased at 7-Eleven, 2411 West Sullivan Road in Aurora. The store received a bonus of $48,500 for selling a winning ticket.

After required state and federal withholding, Cerezo will receive $3.395 million.

When asked if he had advice for other Lottery players, the lucky Lotto winner said, “Play within your means, and when you buy a ticket believe that you can win. ... And check your old tickets!”
