Holmes is charged with multiple counts of murder and attempted murder in the July 20 mass shooting at a late-night screening of "The Dark Knight Rises." The theater shooting in Aurora, Colo., left 12 dead and more than 70 injured.

Prosecutors on Monday said they will seek the death penalty against the man accused in last year's movie theater attack that killed 12, wounded 70 and spurred new gun control laws in Colorado.

The much-anticipated disclosure came in a court hearing held four days after prosecutors publicly rejected an offer by James Holmes' attorneys that the Holmes, a former neuroscience graduate student, would plead guilty to avoid execution.

Prosecutors had said the defense proposal wasn't a valid plea bargain offer, although they could still agree to a plea before the case goes to trial.

"It's my determination and my intention that in this case for James Eagan Holmes justice is death," Arapahoe County district attorney George Brauchler said at the Monday hearing. He spoke quietly and deliberately without any hesitation.

There was no audible reaction from Holmes, who sat in court with his back to reporters.

Holmes' parents sat side by side in the gallery, clutching hands with fingers intertwined.

They were also quiet, as were the victims in the courtroom when Brauchler disclosed his decision, which he said he had shared with no one.

Holmes' attorneys are expected to argue he is not guilty because he was legally insane at the time of the July 20 shooting. They balked at entering that plea last month, saying they couldn't make such a move until prosecutors made a formal decision on the death penalty.

Investigators say Holmes methodically stockpiled weapons and ammunition for his assault on a packed midnight screening of The Dark Knight Rises in Aurora, Colorado, and booby-trapped his apartment to explode and distract any police who responded.

The attack was repeatedly cited by gun control advocates who pushed a hotly contested package through the Colorado state legislature last month. The bills include a ban on the sort of high-capacity magazines thatHolmes allegedly used to spray the theater with dozens of bullets in a matter of seconds.

President Obama is scheduled to visit Denver on Wednesday to highlight the legislation as part of his push for more gun control following December's Sandy Hook elementary school shooting.

As the tangled case against Holmes returns to court, survivors and families of the victims are uncertain about what happens next.

If the case goes to trial, "all of us victims would be dragged along potentially for years," said Pierce O'Farrill, who was shot three times.

"It could be 10 or 15 years before he's executed. I would be in my 40s and I'm planning to have a family, and the thought of having to look back and reliving everything at that point in my life … it would be difficult," he said.

Defense lawyers revealed in a court filing last week that Holmes would plead guilty if prosecutors allowed him to live out his days in prison with no chance of parole instead of having him put to death.

That prompted an angry response from prosecutors, who called it an attempt to gin up public support for a plea deal.

Prosecutors also said the defense has repeatedly refused to give them the information they need to evaluate the plea agreement.

If prosecutors do accept a deal, they will want to ensure that it's air-tight, said Karen Steinhauser, a former prosecutor who is now an adjunct professor at the University of Denver law school.

Holmes would give up his right to appeal by pleading guilty, she said. And although he could ask to change the plea if new evidence surfaces or if he claimed his lawyers were ineffective, "it's very, very hard to withdraw it," she said.

District judge William Sylvester would want assurances from defense lawyers that Holmes is mentally competent to plead guilty and accept a life sentence with no parole, Steinhauser said.

The judge could order a mental competency evaluation before accepting a guilty plea, but Steinhauser said that's unlikely unless Holmes showed some sign of incompetence.

She said Sylvester would probably accept the word of Holmes' lawyers.

If Holmes is convicted and sentenced to prison, the state department of corrections would determine what kind of mental health care he gets, said Alison Morgan, a department spokeswoman.

A third of the state's inmates have moderate to severe mental illness, and the prison system has an extensive mental health division with a 250-bed facility for the acutely mental ill, she said.

Inmates can be sent to the state mental health hospital in Pueblo — where people found not guilty by reason of insanity are placed — but the stay is temporary, and they are returned to the prison system after treatment, she said. Reported by guardian.co.uk 5 hours ago.

Arapahoe County District Attorney George Brauchler said Monday the state will seek the death penalty for James Holmes who is accused of killing 12 and wounding about 70 on July 20, according to a Huffington Post report.

Holmes, who graduated from Westview High School, is accused of being responsible for the shooting that happened in Aurora, Colo. during a The Dark Knight Rises screening.

Prosecutors also said they "reached out to more than 800 victims and family members to make a decision" and on Thursday, rejected the plea deal offer, according to the report.

Volunteers Move Aurora Items After Fire Patch Lawrenceville, GA --

On Wednesday, Aurora Theatre volunteers hauled boxes and furniture and loaded them on to a truck. They were moving everything that had been spared following a fire in downtown Lawrenceville on March 4th.

The Lawrenceville theater had stored costumes, props and sets in a basement space on Crogan Street in the old Belk building. The fire resulted in smoke and water damage to an estimated $250,000 worth of the theater's items.

The stage sets and other items were stored temporarily in a basement space beneath Rock, Paper, Scissors. They would then be transported to another temporary storage site. 

Aurora Theatre is still in need of a permanent place to keep the items and funds so they may rebuild their collection. Supporters are asked to purchase season tickets or donate to the theater's annual fund.

Snapshot: Bible’s Last Supper Comes Alive Patch Montgomery, IL --

Jesus’ final gathering with his disciples came to life with a Living Last Supper production at Wesley United Methodist Church, 14 N. May St. in Aurora.

Co-directors of the church's first such production, Jim Merk and Meredith Lindgren, church members, said the cast comprises 13 congregation men in period costumes.

The production is based on a script by Ernest K. Emurian.

The set is based on Leonardo da Vinci’s famous painting, “The Last Supper,” a late 15th century muralpainting in the refectory of the convent of Santa Maria della Grazie in Milan, Italy.

The painting represents the scene of the Last Supper of Jesus with his disciples, as told in the Gospel of John, 13:21

A musical interlude featured the Chicago Classic Stings and a combined choir of singers from WUMC and Fourth Street UMC, both in Aurora.

Bill Nelson of Aurora directed the musicians.

Aurora Shooter Pleads Guilty To Avoid Death, Prosecutors Reject Plea On March 27, Aurora theater shooter James Holmes entered a guilty plea to avoid the death penalty, but prosecutors believe it's a "publicity stunt" that "may violate gag orders the attorneys signed in the case."

In fact, prosecutors responded with a 12-page motion that denies that the plea constitutes a legitimate offer.

Instead the prosecutors believe defense attorneys could be trying to draw the court into a public spectacle surrounding plea negotiations.  Moreover, the prosecutors asked if the plea was filed as part of "a calculated attempt to improperly inject the issue" into public debate as well.

Doug Wilson, head of the Colorado Public Defenders Office, has suggested Holmes' defense attorneys "might not have told victims and families of the shooting that a plea offer was on the table."

Vincent F. Stanek, 82, of Yorkville, Illinois passed away on March 26, 2013 at The Tiller's Nursing Center in Oswego, Illinois.

Born on July 22, 1930 in Aurora, Illinois, he lived in Eola and on Eola Road most of his life.  He married Rose A. Lohrey on August 8, 1953.  She survives.  Also surviving are his six children;  Judith (Roger) DeVore  of  Peoria, Illinois, Jenifer Pfeifer of Joliet, Illinois, Terry (Liz) Stanek of  Lake Holiday, Illinois, Susanne (Mark) Eichelberger of  Plainfield, Illinois, JoAnna (Rick) Priegel of Yorkville, Illinois and Mary (Robert) Fleming of  Spring, Texas. 

He also leaves behind 15 grandchildren and one great-grand daughter who were the joy of his life.  Furthermore he is also survived by his siblings, Francis Glover, Elizabeth Kramer, George Stanek, Rosemary Fisher, Joseph (Marilyn) Stanek and Theresa Anderson, as well as numerous nieces and nephews.  He was preceded in death by his parents, Frank and Frances (Lastufka) Stanek and one sibling, Sister Anna Fleurette.

Vincent graduated from Marmion Military Academy in 1949 and served in the United States Army during the Korean War.  He retired from Caterpillar Tractor Company in 1993 with a large part of his career spent working at Austin Western Company in Aurora, Illinois.  He was a Mechanical Engineer.  He was a member of The Catholic Order of the Foresters. Vincent was a devout Catholic who was a member of St. Therese Catholic Church of Aurora, Illinois for most of his life, serving on numerous boards and committees as well as ushering.

Vincent was a caring man who was passionate about his family, his faith and his many hobbies.  His true joy in life was gardening and he often said he "loved to get his hands in the dirt". He transformed his three acres of bare land into a fruit orchard with dozens of trees.  He enjoyed organic gardening and kept bee hives.  He generously shared the fruits with of his labors with family and friends. 

In addition, he was very involved in woodworking and carving and created many beautiful pieces of furniture and works of art.  He loved sports of all kinds and was an avid Chicago White Sox fan.  He was known for his energy, his honesty and his generosity and, despite his busy life, was always willing to come to the aid of anyone who needed help. 

A funeral mass will be held at noon on April 2, 2013 at our Lady of Mercy Church on Eola Road.  Visitation will be held immediately prior to the service from 10:00 a.m. to noon.  In lieu of flowers, memorials may be directed to the Alzheimer's Association Greater Illinois Chapter, 8430 W. Bryn Mawr, Suite 800, Chicago, Illinois 60631.

Vincent was a character, he was brusque on the outside with a heart of gold.  He touched many lives.  He was responsible for creating many lives.  He will be greatly missed.
